The driving license issued by the transport department cannot be used as a proof of residence, according to the state home department's(transport) recently issued circular. The circular issued by the chief secretary Ratnakar Gaikwad further states that the driving license is being used as proof of residence while applying for various certificates at the government offices and also while procuring the mobile SIM cards, telephone and LPG connections. The respective departments and agencies also accept the driving license as a residence proof. The circular has clarified that the license is issued only for the driving of vehicle; and it cannot be used as proof of residence. According to the circular, after collecting the information from the regional transport offices (RTO) pertaining to the driving licenses, the transport department has found that the applicants have furnished the licenses on fake addresses. The orders are issued to the respective RTOs to cancel such licenses and initiate action against the applicants. Considering such cases, the guidelines are being issued not to use driving license as a proof of residence. The circular has stated that it is must for a driver to carry the driving license while driving a vehicle.

Harshada Ghia lives in Prabhu Nivas building on Charni Road and has illegally built safety doors, blocking the common passage for the fire exit. In a letter attached as an annexure to the petition filed by Ghia, Kania had stated that safety doors were there when he was a tenant in the building, though he doesn’t remember whether the door was there on block no 21 on the building’s second floor. According to Ghia, the building was constructed in 1933 and he took over possession in 1975 from the landlord, Rajesh Reshamwala. In 2000, the tenants moved the small causes court against the landlord for doing minor repair works. In 2007, the landlord complained to the corporation, saying that the tenants on the second and fourth floor of the building had illegally built safety doors. The civic body issued notices to the tenants. Ghia said the building has been in existence since 1933 and the Mumbai Regional Town Planning Act, came into existence only in 1967. So, it would not apply to his case. A division bench of Justice PB Majmudar and Justice MR Bhatkar said: “You can’t claim relief even when other tenants have removed their illegal construction.” Ghia said the entire process of issuing a notice by the BMC was illegal and should be set aside. BMC counsel, Preeti Purandhare, who opposed the plea, said: “Three other tenants of the building have demolished their safety doors and have initiated proceedings at the city civil court. The present petitioner has no right to appeal directly and if he wants to challenge the notices issued by the civic body he should move the civil court along with other tenants.” Ghia wanted to withdraw his plea to take appropriate legal recourse. Purandhare opposed that, stating: “He can’t have everything at his convenience.” The bench dismissed the plea

ICICI bank,shameless Indian judicial system, capitalist govt, and looting system

To, All those concerned by looting of banks : Read my mail to : The CEO, ICICI Bank , Hon Chief Justice Supreme court of India ( slow judicial system), Ho, Finance minister, ( Hands in glove with looters of economy) Hon. Governor , RBI, ( Hands in glove with looters of economy) I believe the card is more then 5 yrs old but that may be a different ICICI card. I have always paid regularly but 1. Once the bill never came. Thanks for reversing charges. 2. I sent the chk but did not reach your bank as claimed but charges were reversed then . Thanks. 3. In present case . In 50 days both my parents expired and suddenly. Still chk was sent to ur ATM nr reliance energy counter at santacruz east but they have stopped the drop box system and I dont know what happened to that check and i immediately on knowing made payment. Yet Rs 400 /- is charged against outstanding of Rs 500/-  ( how the charges can be 90% of dues in question ) and interest rate is mindbogglingly high. My questions  are: 1.Why drop box facility is stopped in ATM. 2. Why there r no other drop  box in santacruz East Vakola area. 3. Why the delayed payment charges are so high. 4. why interest rate is so high/ 5. Pl. explain :   This would also help you to prevent any negative points in your credit rating. What do u mean by this ???  Are individuals rating done by mere delay in payment even when crisis in life are there?? When all actual usage amunt is paid and there is a dispute in paying unjustified high amount of penalty and interest. To, The governor , RBI, and To, Hon Finance minister, Pl. ensure that no adverse credit rating of any individual is done if all loan , usage amount of credit card etc are paid and there is a dispute in bank charges which are fixed unilaterally, are very high, and are comparable to patahan / colonial / sudkhor era. bent towards capitalism and govt is allowing this / is party to this shows they r hands in glove in this loot game and their claim for democracy for common man , socialism . and citizens welfare is only sloganeering. No other institution charges such high penalty and interests. Why RBI allows that for banks?? I am a shelter provider to those migrated to Mumbai as homeless and would have lived in slums or footpath. But the landlords gave them house so they could call their female to live decently , so that they do not go on highway and railway lines to attend to morning calls but the same government does lot allow to raise rent so we are still left to manage with Rs 30/- per month per room. That means for using the whole room of about 150 sq feet we can charge only Rs 1( ONE) per day. Then they use common [passages, toilets, garden , terraces , and whatever legally and illegally accessible), then they abuse and threaten landlords, then they illegally park cars in premises worth even Rs 8 lacs + , etc etc and yet pay no rent for 25 years , not even meager Rs 30/- per month. Options before me are pay 2000/- to recover Rs 30/- to advocate for notice. Then pay Rs 1 lac + , then xerox charges, then tips to bailiff for serving summons, pay so many out of pocket expenses and file a case against non paying tenant. Then use dirty paan spitted everywhere corridors, stairs, toilets of these great places of Justice of India , then waste your whole life on court benches as Judges get their salary and promotions even if they give only adjournments, advocates get fees in advance even if you have to chase for them as beggar when matter is called out, you keep giving tips to staff of advocate and courts and get nothing form any one of them for 20 years. And no court is charging Advocates for appearing without preparation, for not filing due papers in time, for parties not remaining present but banks change like nibble-man and thrive on such charges , make palatial offices and house with swimming pool for CEO of  ICICI bank. With this unjustifiable high penalties and interest. Am I slave for free person. I have to pay Rs 40/- for pay and park for  1 hour pay such high bank charges but recover Rs 30/- per month  for 150 sq feet and yet pay ever increasing municipal taxes from my pocket. All this is fixed and run and decided by govt, judiciary, and bureaucrats  of which I am a slave but called citizen with equal rights and privileges. What a cheating and fraud and day light robbery by all above. And worst is we have to bow to such people who do not deliver justice for decades as  slaves have been bowing to their masters. And my proffession: As a insurance agent clients do not want to fill form, want me to remind several times, want me to collect premium, help in claims, and do lot of other work ( like change of address etc ) but they want back my commission. The committee wants Kumar to pay Rs 700 every month to park his vehicle in the parking slot that belongs to his flat owner and landlord, even though the society collects parking charges from the owner every month. “The managing committee has made its own rule to make tenants pay for parking,” said Kumar. “Almost every second day, the committee members land up at my house and harass me.” Like Kumar, there are many flat owners and tenants across Mumbai who are fighting it out for parking space in a cramped city where the number of flat owners and the number of vehicles in a society exceeds the number of parking slots available. “The most common cause of disputes among society members is parking space,” said Wahid Ahmed, a real estate agent with Spaces Property Consultants in Juhu. NP Nathani, 41, a chartered accountant, bought a 2BHK in Thakur Complex, Kandivli (east), in 2004 and paid the builder Rs 1 lakh for parking. But now, seven years later, the society has demanded that he surrender his parking space so that it can re-allot all parking spaces in the building. “The society says it’s illegal for builders to sell parking space, so I have no right over that slot,” said Nathani. “The committee needs to take into account flat owners like me who have spent money buying parking slots. I am being denied my right to something that I have paid for.” Though it is illegal for builders to sell parking slots to homebuyers, the housing society bye-laws clearly state that if a resident has bought a parking space, then he or she is entitled to it. This discrepancy in the state laws and the bye-laws under the Maharashtra Cooperative Societies Act is the source of many disputes across the city. Vivek Gupta, 47, a physician, is unwilling to pay the monthly parking charges because he has paid the builder Rs 2 lakh for a parking slot in his building on Peddar Road, where he owns a 2BHK. “The parking charge is not much, but I don’t see why I should be made to pay the society anything for parking,” he said. Anand Divekar, the chairman from Gupta’s society, argues that as it is illegal for the builder to sell parking space, it is only fair that Gupta pays parking charges like other residents of the society. Ahmed said in several housing societies, many flat owners are forced to park their cars outside the society compound, in some cases for as long as a decade. “Often, managing committee members allot extra parking spaces to themselves and their friends.” With society members fighting for space, there’s no thought given to the need for slots where visitors can park temporarily. Diven Pednekar, 26, a model, complains that no parking space is reserved for visitors in his society in Four Bungalows. “When guests come, they are told to park outside, on the road, because there isn’t adequate parking for society residents,” Pednekar said. This despite the fact that the Development Control Regulations state that 10% of the parking space in suburban societies and 25% of parking space in societies on the island city must be reserved for visitors.

Water Taps left open while going out by residents of 1st floor

Dear All,
U r all aware that water is a necessity.
That wasting it is a national crime as our country has shortage of water.
That we have one common water meter and if anyone’s tap is left open then water gets wasted and others do not get sufficient water. Specially when tap is left open by person  who has tap on low level then person on higher level does not get water. My water tank is on terrace and thus is on highest level and if water is kept flowing on 1st floor level then my bathroom does not get water and 4 of us use that bathroom and so on…..
That I have bigger family, we pay more towards sharing of water and we have senior citizen in our family.
That at all times my family has given water and several other assistance to those who suddenly arrived from Jaipur etc and helped in various other ways in crisis.
But it is sadly found that while going out without having any regard to the inconvenience it will cause (god knows intentionally or unintentionally) taps were left open by other residents’ in their homes. And doors were under lock and key.
It created over flow resulting in:
1.        Wastage of water which is a scarce national resource which none has right to waste even if paid by him.
2.       As our share is higher we will be paying for wasted water which is a additional burden on us.
3.       It created shortage of water and we suffered from less or no water.
WE here by appeal to all residents of 1st floor to ensure that when they go out of their room for overnight or longer period then pl. check water taps and keep them closed and ensure no water is wasted.
I am sure you all will cooperate and ensure that there are no escalation of such issues. We would not like to take legal recourse available to us on same if due care is taken and all behave as responsible neighbors and citizens.

Are judges out of reality with realty market of Mumbai??????


In year  2010  Hon  Small causes court  fixed  mesne  profit rent of a tenant using self  contained room in a RCC building in a convenient location with water and electricity    as Rs. 1000/- p.m.  . The ex tenant is very big gems and jewelry  exporter living  in Jaipur. Hon Court had  evidence and admission before it that  said tenant possessed bungalow in Jaipur, travels abroad for years  in several times in a year, has many four wheelers, and two wheeler s etc etc.Yet due t o a senior advocate representing and saying he cant afford higher rent  court has fixed rent at Rs 1000/- p.m. . Today's i.e. 13th August 2011 Times of India  on first page  says that in slum  where living condition remains sub human the rent  is  Rs.10000/- p.m.. What the advocate wanted was we dispute the low rent fixed by hon. court and he gets  chance to delay the matter. We consented. Then came turn of depositing the rent. Months  have passed and the rent was not deposited inspite of court orders. Application for condonation of delay was filed. Why??? So that we oppose and matter is delayed for few more years. We had no choice but to consent. So we see how senior advos  thrive ?? Not by taking matter  with some life and not by fighting matter on law point but by managing delays ..Hon court has been silent spectator.to all this.

Mumbai: The realty market is booming in Mumbai.But not in its traditional posh,suburban or newly developing pockets.It is flourishing in the teeming slums that house 60% of the citys population.The informal property industry here is easily worth several hundred crores a year.Some tenements in these areas sell for as much as Rs 15,000 per sq ft while rents for the humble hovels can soar as high as Rs 10,000 a month.Its another matter that the living conditions almost always remain sub-human.
Thousands of shanties in prime locations are regularly bought and sold under the radar of government scrutiny.The market boasts its own set of brokers and investors.Most transactions are done in cash and the only loser is the government,which does not receive stamp duty, says Sharad Mahajan of Mashal,an NGO working in Dharavi.

Skolda car of illegally inducted sub tenant by another tenant



An illegally inducted sub tenant Mr Pillai owns this Skoda. They pay Rs. 40/= p.m. to Mr Chadda. Who in turn pays nothing to landlords that is we for over 25 years.  Mr Chadha has one santro and one Honda. I have Maruti estillo . Who is rich a tenant or landlord? They pay or are suppoed to pay Rs. 40/- approx pm as per sick 60 yrs old rent act but I pay ever increasing muinicipal taxes, property tax, assessment etc etc besides emergency repairs. And inspite of living for meagre rent they instead of thanking keep abusing, misusing, over using, illeagally tresspassing etc etc.. Mr Pillai does not stay here and live in another huge flat.

U r wrong in every statement. Atleast in my case.
  1. I park my car half in open and half shade available to me. But my tenant who has not paid rent for 25 yrs is parking his 8 lac Rs. car Honda under illegally built shade. Come and see.
  2. He is storing a 20 yrs old skeleton of a scooter in common passage to claim extra rights.
  3. He had one more car which is only used by a family of another tenant. (What is an arrangement???)
  4. He has enclosed the passage without permission.
  5. Another person has locked the room for years and not staying and I wanted desperately a room for my daughter who is a dentist and working for 5 years with a trust running a clinic. He asked for Rs 30lacs for a 180 sq feet room which was originally a garage. Does not have a toilet. Does not have a water connection. There is no window. No separate kitchen. Pays Rs 40 pm to person inducted him illegally before we purchased the building.
  6. Another tenant has kept all rubbish and dirty belongings in common passage, in common bathroom and use terrace for urinating, use walls to spit and throw I don't know what but do visit me to see everything to believe.
  7. One of the trespassers is running a hotel in another old building, he has no license, made illegal structure, does nuisance everywhere and pays nothing. This person called me once and begged for Rs 15000/- so his seriously ill wife can be operated. He promised to return same in 15 days. But even after 10 yrs not a single penny has come. Several visits and follow up have gone in vain. He wields influence of one congress corporator who in turn is a man of a very powerful UP leader from the area. I have filed several RTI in police and BMC but u will see (pl. come and see) that under pressure of these goons none of the replies have come in time and are all twisting the facts.
  8. There a paan shop and his rent is Rs 40 pm. Is not paying for 3 years or so. Has illegally given part of shop for stocking illegally inflammable stocks of shoes etc .Makes abt Rs. 50000/- per month. His father was a nice person and good friend of mine. He used to pay rent in time even when got affected with cancer. I had extended full help to him during his last days. Then after his sad demise his widow and sons approached me for change in name. I offered them a cup of tea and did the needful in five minutes. Did not take a single paisa or never went to their shop to have a pan or cold drink in my life time. But now when sons have taken over they say we are a men of one safforonist org and will not pay. They have another business near Santacruz Station too. One of the brother is software engineer and doing very well.But this  a common attitude of tenants of over use, misuse, and delay / not pay rent and yet get support from all as may be some landlords were bad.
  9. Mrs. Bina Chowdhuri filed several cases on earlier landlord too. The year I purchased that building in 1989 (as we were the major tenant on ground floor of commercial premises and landlord desperately wanted to sell. We were tenants since 1947 or prior of entire ground floor. Never ever defaulted in paying rent. Never sent a notice to landlord, never filed any case against him and maintained very good relations with them as: Even today we cherish in our heart respect and love for them the simple, religious goan Christians. If they had not built and rented these shops to us at a negligible rent (about Rs 150/- for 1500 sq ft) our family would have been doing business on footpath like the new migrants do as rent cat has stopped investments in rent able properties. We would have been squatting on roads and railway lines like all migrants now living in slums and footpaths do....and so on. If there is any important virtue for human being ( worth being called a human) is one compassion and second gratitude / thankfulness/ paying back to those who have trusted you and given u something in life be it ur parents, landlord, society, nation or even a garden or hospital which u use and are created by others/ charities. But we use such places and spit/ litter and come out. But the genes in my family are different and loyalty, thankfulness, gratefulness are our virtue and we treated our landlords as shelter providers and respect them and vow to support them if need be.

U have said abt landlords and influence etc  Here is a true tale with one tenant (we had relations better then a family but incidentally they were on paper tenants) :Grand son of my beloved bauji  Late Shri Navratan Goyal called  me at dead of night that his  grandfather is not well. He added that his parent is not at home and not likely to return soon.  I immediately called our family doctor Dr. Lily Tolat. She told me to rush him to nr by nursing home as she said he is a heart patient and that symptoms were of heart attack. I immediately jumped out ( knowing value of golden hour) , filled my pocket with whatever money I had at home and rushed to ground floor while instructing to call Hinduja Hospital. No sooner I reached him to Hinduja ( not giving step by step account as ur time is precious) in my Maruti the casualty staff waiting outside picked him and in casualty put him on all kind of life saving equipments, injections etc .. Then they informed it is a massive heart attack and any delay would have been fatal. Did I wait to change? Did I feel reluctant to rush him in my car leaving wife alone in bedroom? Did I wait for Mr. R N Goyal ( now retd V. P. Piramal Mills ) to come and pay for hospital expenses?? No. More than a tenant he was my neighbour, family and a sr. citizen and I had to do what I must do. That is a relations we keep with all but some looters/sinners/exploiters forget all that and give abuses, misuse, not pay rent, take us to court on wrong grounds etc.. And yet media and all others say landlords are bad) and I did what a responsible.
I am not writing here more abt great neighbors (incidentally tenants of ours) like Thakkar family, Mehta family, Gupta family with whom we enjoy best of relations and part of all family functions where no other tenant is but only our family inspite of being their landlords of past. (Now most of them have reached very great heights in their life one of them being President of a group of Rs 3000 crore.

If u or anyone wishes pl. come and see all this is narrated live/ documented and I can introduce few old good tenants too. So it is not necessary that all saints are bad if one of them does molesting, not all govt staff r bad, not all politicians are bad similarly not all tenants or all landlords are bad so do not whip all landlords with same  stick. I don't curse all tenants as we too were tenants and are looking for premises on rent for even my daughter. And even our landlords were very good, very nice and gave us opportunity to start our career from zero in Mumbai 65 yrs back. And I am not kamina to harass such shelter providers, give them notice, take them to court, misuse, and over use my rights. I am also not kamina to do anything out of law or morality against tenants. But like it is due to law they do not pay higher rents same law allows landlord to take certain steps against erring/ defaulting tenant.
The law says you cannot take action yourself and aggrieved then approach police and court so if any landlord approaches police or court then what is wrong?? It will be wrong if they approach Mafia. But not police and court. Ur saying they influence police. Money influences most authorities. My most tenants have 10 times more money then me. Their advocates are the costliest viz. Ad Amin Nathani, Ad Divyakant Mehta. You can find out what influence and fees they have. I am giving their name openly. I can give name of UP leader backing one of my trespassers in running illegal hotel only in person as that sure will invite wrath.

How far system has been misused by tenants?
1. One case file went missing and I had to knock doors up to 6 months and up to Supreme Court. So various methods are adopted by tenant to delay case. And matter is liberally adjourned.

2. Tenant went in appeal court but did not file papers for a year. Court did not say anything.

3. Then court fixed manse profit of Rs. 1000/- p.m. . . . We had given copies of agreements of different leave and license in court. As per that rent prevailing in area comes to Rs. 10000/- and we had asked for Rs 5000. - Per month.  Court in order said we have not given valuer's report. Fine. But while responding to tenant that he can't afford higher rent court agreed that his daughters are studying and that he says he can't afford. There court did not say if u claim u can't afford then u have not given copy of ur ration card that which colour bears, that give ur IT return, etc ?? And in the suite we had already brought on record that tenant has a palatial bungalow in Jaipur , owns farm house, owns several cars, scooters, travels abroad several times in a year etc.. But court did not take all this in account and fixed rent of Rs.1000/- . Come with me in my area and u will find that in slums rate for 280 sq feet is Rs 5000/- p.m... But court is supreme and we have to respect court as else we will be put behind bars for challenging court the almighty.

4.  Then on silly ground they sought condonation of delay in paying even that paltry rent ( and as told earlier their advocates are one of the costliest in Bandra Small causes court)  inspite of court orders. We allowed it as that is what they wanted we object and then they will delay in arguments for years on their application for condonation. And court will allow that.

Now abt landlords charging transfer fees and other monies:

As is always told by all bureaucrats when they come to our meetings: don't pay money wrongly/ don't pay and encourage bribing. Same applies here. Then even for a death certificate, even for probate, even for transfer of name in property records you have to pay officially and 10m times more unofficially.

BMC came and removed my name board from the building of my compound because I complained against illegal huge banner put up by BJP in front of my building at vakola. You can find that huge banner 365 days on Vakola Bridge in front of my building. They removed small steps made in front of gate on road as my sr. citizen members found it difficult to enter the building as that is always water logged and they don't clean the storm water drain and which is every year choked. They wanted bribe for cleaning the drain which I did not give and they removed the steps. But they don't remove the unauthorized structures built all over as they get bribe. 50 % of Mumbai is illegal and paying bribe. Did u object to that? If u had done so then at least some open spaces we cud see in Mumbai. But u object on landlords taking money.

My daughter cud not study further for masters as D Y Patil College asked for 33 lacs for admissions. I have stopped going to a big hospital as they arm twisted me and inspite of emergency and patient my father of 89 yrs they forced me to accept Super deluxe room costing Rs 10000/- per day ++++ Doctors  visit, medicines, tests extra inspite of   twin sharing room available. They said it is management policy. Want to come and check this fact at Asian Heart?
My cousin paid a bribe as doctors in Sion hospital said pl. pay a bribe or the dead body of father will be given only next day. My sr. citizen member Mrs. Hansa been told me they had to bribe Bhagawati hospital straff to take body oy their only son died in train accident. Has any landlord ever charged at such merciful occasions? How many such occasion's u have protested?? And I have and thus am unsuccessful man.
I know of a landlord whose tenant who never paid for 25 years and died . This landlord removed his car from parking place to give convenience to these tenants funeral. He shared his toilet etc with relatives who came to mourn for 13 days. He helped them when their house was flooded. But he gets worst ever abuses from tenants as some people are like that.

I can go on but best would be let TV channels take footage of these buildings and call landlords and tenants for open discussions to bring the truth out. Till then u pl. visits my building and I will show you the facts.

And last but not least I still with folded hands solicit good relations with my tenants and willing to forget past if hence forth they live with peace, live as a responsible, lawful citizens and follow the rent act in toto and not just what suits them. I reiterate if a good tenant wants to quit he has right to fair market price in compensation but not by blackmailing, threatening, arm-twisting and 4 of my tenants have gone that way on their own accord as they rose in life and still we have good old relations with them.

U have not mention the other side of the coin where with every transfer of tenancy, Landlord enjoy 1/3 of deal amount as transfer charges, as well they also take advantage of demanding hefty monies for all repairs done by tenant, even if the repairs r very legitimate and necessary. This way almost all landlords make a good killing. Apart from this, one can also come across n number of cases where landlords bully and harass financially or physically weak tenants who cannot match them in police station as well as legal court room fights.

There appear no government/administration in line with the constitutional rights of citizens in the "said to be democratic government" which became a republic in 1950! This is proved time and again and the recent crack down at Ramleela grounds further confirms it !

this time of politicians misleading tenants for showing them that he is masiha (just for vote) are responsible for the bldgs becoming dangerous as due to non return landlords are unable to repair & maintainance.Then  force fully work of  bldgs  repair are given toM B R & R  boardcontractors (who favours them aboutr 30% kickback) these contractor take away teak wood of old bldgs and replace by substandard materials

tenants living lavishly but paying Rs. 40/- p.m.


I dont know what prompts Divyakant to live in fools paradise and continue to suck blood of shelter providers. My tenants have Honda city,large LCD TV, spend on booze Rs.10000/- K ( as per his own claim.But the rent for 800 sq ft is Rs 138/- which he is not paying for 25 years. But he is paying every month Rs 500 for Dish antenna rent, 2000 for broadband, 3000 for mobile and so on. Come and visit my building and see for urself. I want to get IT retuns copy of my tenants. There is a tenant who has a Honda city and santro. Has lot of other investments. But does not pay his Rent of 128/- p.m. for 800 sq. ft. Can I get his IT returns to show to court? If yes then can someone pl. give me draft of same RTI application?? I will be huighly obliged.
