Dear All,
I have received today notice from BMC demanding increased property tax from back date from 2010. The notice is claiming Rs. 25967/- . In case of failure to pay they have threatened to levy penalty of 2% per month that is 24% per year besides penal action and auctioning the property.
Sir/s,
Out of three tenants and two trespassers only one tenant pays Rs 34 pm to me as rent.
The tenant Chadha has two cars worth Rs 13 lacs and all other luxury but does not pay rent as he and other defaulters know that I will have to spend life and Rs. 1 lac minimum in court case for trying to recover rent which may still be elusive as he will deposit in court.
The Purohits lost case in 2009 and were decreed but went in to 2 bench appeal where they have hired Ad D C mehta who knows how to delay matter and does not us law but uses machinery for delaying. Ad mehta is a very costly advocate but he claimed my client is not able to pay more then Rs 200/- p.m. as mesne profit . It is on the record of court that his client has more then 5 vehicles, palatial bungalow, travel by air several time to US and other countries, has office and house in Newyork too. But court fixed mesne profit as only Rs 1000/- which I can not withdraw till order ( which is elusive for 5 years) . I asked thru RTI info on how the court has fixed in other mesne profit but court has only made me run here and there and denied info on procedural ground . I asked AAP volunteer to file similar RTI in same court but he too got tired.
I am not allowed to increase rent as much as BMC or others hike be it railways, professionals, grocers, parking lot wala's, milk vendor,Reliance energy, schools, colleges, doctors, hospitals, hotels and so on. .
I am not allowed to charge interest more then 9% from defaulting tenants and can not evict them but BMC is charging 24% interest and can take penal action and also auction my property.
I wonder what sin I had committed in last life that I am not a son of IAS,IPS, JUDGE, VIP etc ??? Why I am a AAM Admi?
Sir do I pay these taxes ???? Pl. advise??
Also advise where do I get these funds if I do not have post where I can get bribe or commit scam??

Pl write a proper petition to the Prez/PM/CM/Mayor etc and make it available electronically to Medi Houses/Political Parties. Tenancy issues are most sticky/tricky. Laws,for long,haver remained loaded against house owners,considering tenant to ber vulnerable/poor and houseowner to be rich and powerful. Amendments have been slow to come by. Get a long term stay on the BMC ordet through the Court,citing genuine reasons as indicated in the petition addressed to the big guns. Some pwerful RTI activist might be able to follow it up to the logical end. Pl send the issue to all National Law Universities to figute out a generic solution. There cd definitely be an opportunity out of the adversity.spm

why you always thing negatively about self and other it is the very big issue with in you this is observation of mine by reading your emails , it has to be get clear by way of self meditation .
now about your issue (solution )
1) you have to write a simple letter to the commissioner of BMC and marked the copy of said letter to tax inspector of concerned ward by informing them that they have to collect the municipal property tax from your tenant directly since they are not paying you the permitted increase property tax of BMC neither property tax of BMC.
in BPMC Act there is a provision when corporation is collecting the property tax from occupant or user of premises .
2) high court has made the rules about RTI and due to the said rule there is heavy difficulty to getting the information from court so .i have already filed the PIL against said rules of HC in HC and the said PIL will be going to get decided very soon.
3) your case is under rent act and it is merit full case you have chance to get success if you show the paper to experience expert.

I am also AAM Admi. But as per my knowledge,...........
Better you should try to Redevelop this Property any how with your partnership with Reputed Builder.
I know that Tenats who pays monthly Rent directly to Court , dosn't have right to object your redevelopment Plan.
( But you have to give Flat having Space as per BMC rule)& after construction of Tower, Get Society Register.
Note : If you wants to Cut Diamond, you have to use Diamond cutter only.

Yes this type of case may be successfully handled by Powerful Builder Loby ( who is using all the means to fight ).
Otherwise Simple & Ordinary Landlord can not handle this case successfully.

Thanks Hitesh bhai. Earlier even if tenant wished to go then I hv paid them market rate even after borrowing funds @ 18%.
But presently remainent tenants are asking three times of market price or more then BMC rules.
Rather in suburbs there is no extra benefit to landlords for giving back redeveloped new house to tenants as is given in South Mumbai where for redevelopment you get 4 FSI.
Still I am willing to give same area as they occupy but they want much more or they blackmail that they will not cooperate.
